-Our community’s desire is to not have legal issues arise because of US federal law that directly impacts on not posting certain content.
-18 USC 2254 prohibits minors from performing in potentially sexually explicit material.
-DMCA concerns copyright infringement and the removal requirements for copyright infringements not deemed fair use.
Ultimately the poster of material here is legally responsible for perceived copyright infringement issues or demonstrating that the doctrine of fair use applies.
The forum is not involved with that determination; we would be required to remove such material and the poster would have to deal with the copyright holder or the legal system itself. We permit links because we as a forum are not liable for links elsewhere to material in compliance with 2254 matters and because that use is for the poster to justify when a copyright holder demands removal and not these forums. Hence that is the basis of several of the forum rules.
It is the poster’s responsibility to be compliant with forum rules and the legal principles that gave rise to them.
The moderation team continues to work through how to explain what we have to do with these legal requirements on the one hand and protect this community on the other.
